And known as being a Part of Section No. 1 of the Original Survey of Springfield Township and more definitely located and described as follows:

Commencing at a survey monument set by the Mahoning County Engineering Department in the intersection of Donaldson Road and Ohio-Pennsylvania State Line Road, thence due South along the Centerline of State Line Road, a distance of 440.35 feet to an iron spike, the true place of beginning; thence N. 81 degrees 50' W passing over an iron pin at the side of the road, a distance of 518.67 feet to an iron pin; thence N. 0 degrees 15' E a distance of 410.0 feet to an iron pin on the South side of said Road; N. 81 degrees 17' W a distance of 503.47 feet to an iron spike in the centerline of Felger Road; thence along the centerline of said Road, S. 38 degrees 10' W a distance of 970.0 feet to an iron spike; thence S. 0 degrees 27' E a distance of 956.63 feet to a stone marked with an X in the North line of property now or formerly owned by C. F. Eckman; thence along the North line of properties of Eckman and Woloszyn S. 89 degrees 50' E a distance of 1189.64 feet to an iron pin: thence S. 89 degrees 50' E a distance of 363.0 feet to an iron spike in the centerline of the State Line Road thence along the centerline of said State Line Road due North a distance of 1046.2 feet to the place of beginning in accordance with an actual survey by Arthur W. Waldo, Registered Surveyor, and containing within said bounds 51.58 acres, more or less.

Less and Except: Situated in the Township of Springfield, County of Mahoning and State of Ohio and known as being a Part of Section No. 1 of said Township and being more particularly bounded and described as follows:

Beginning at the intersection of the centerline of Felger Road with the Southerly line of lands now or formerly owned by the Carbon Limestone Company; thence Westerly along the Southerly line of said lands of the Carbon Limestone Company a distance of about 429 feet to the intersection thereof with the Easterly line of lands now or formerly owned by R. E. Preifer; thence Southery along the Esterly line of said Preifer's Land a distance of about 577.995 feet to the intersection thereof with the centerline of the Felger Road; thence Northeasterly along the centerline of the Felger Road, a distance of about 726 feet to the place of beginning and containing about 2.89 acres of land, be the same more or less, but subject to all legal highways.

Being the same property conveyed to Raymond J. Lyda, an unmarried man by deed from Dorothy A. Lyda, a Widow, and Raymond J. Lyda an unmarried man recorded 09/26/2007 in Deed Book 5719 Page 1944, in the Recorder's Office of Mahoning County, Ohio.

Situated in the Township of Springfield, County of Mahoning, State of Ohio:

PARCEL NO. 1: and known as a part of the Northeast Quarter of Section 3 of the original survey of said Township and being a parcel of land bounded and described as follows:

Beginning at a point in the South line of Poland Township where the same is intersected by the East line of lands now or formerly owned by I. M. and Samuel Greiner and running thence East by the South line of Poland Township about 661.1 feet to the West line of lands now or formerly owned by Susannah Foust: thence South by the West line of Susannah Foust Lands and by the West line of lands now or formerly owned by S and K Kosak, about 2.604 feet to the North line of lands now or formerly owned by Clarinda Zeigler, thence West by the North line of said Ziegler Lands about 657.6 feet to the East line of Lands now or formerly owned by John Zeigler; thence North by the East line of lands owned by John Ziegler about 1353.6 feet; thence West by the North line of said John Zieglers Lands about 6,570 feet to the East line of said Greiner Lands; thence N. by the the East line of Greiner lands about 1,355.3 feet to the place of beginning, and containing within said boundaries about 61.27 acres of land. Also the grantor's interest in and to the easement for driveway purposes over that portion of Lot No. 3, which lies between the tracts described and the public highway.

PARCEL NO. 2: And being located in Great Lot No. 3 of said Township and further described as follows:

Beginning at the Southwest corner of the Northwest Quarter of Lot No. 3; thence North along the East line of said Quarter Section, about 1,355.31 feet to lands formerly owned by Susie Kukula; thence East along the South line of said Kukula Land, about 657.85 feet to the East line of said Kukula Land; thence South along the said East line, about 1353.66 feet to a point and the North line of lands formerly owned by Clarinda Zeigler; thence along the North line of said lands, about 657.03 feet to the place of beginning and containing 20.42 acres of land.

Being the sme property conveyed to Raymond J. Lyda, an unmarried Man by deed from Dorothy A. Lyda, an unmarried woman recorded 03/03/2004 in Deed Book 5419, Page 1037, in the Recorder's Office of Mahoning County.

AND BEING FURTHER KNOWN FOR STREET NUMBERING PURPOSES AS: 9315 Felger Rd., New Middletown, Ohio 44442.

PERMANENT PARCEL NUMBERS: 01-002-0-002.000, 01-002-0-003.000, 01-001-0-003.000, 01-073-0-005.000 and 01-073-0-006.000

APPRAISED VALUE: $439,000.00.

Terms of Sale: Deposit in the form of a CERTIFIED CHECK as follows: $2,000.00 if the appraised value is less than or equal to $10,000.00; $5,000.00, if the appraised value is between $10,000.00 and $200,000.00 or $10,000.00 if the appraised value is greater than $200,000.00 (No deposit if Plaintiff is the Purchaser), balance in full within thirty (30) days from THE CONFIRMATION OF SALE.

AND if this sale results in a NO BID/NO SALE and remains unsold after this first sale, then this property shall be offered again at a second sale and shall be sold to the highest bidder without regard to the minimum bid requirement in section 2329.20. (ORC 2329.52(B), ORC 2329.26 (2)(a)(v)).

The purchaser shall be responsible for those costs, allowances and taxes that the proceeds of the sale are insufficient to cover. (ORC 2329.52(B)).

Sheriff's Sales may be canceled due to inclement weather or other county emergency. In such cases, the sale will be held upon the reopening of the Mahoning County Courthouse after the emergency has passed. Republication will not take place. However, notice of the new sale dates will be posted on the internet.
