By virtue of an Order of Sale issued from the Court of Common Pleas of MAHONING County, Ohio, and to me directed and delivered, I will offer for sale IN THE COMMISSIONERS' HEARING ROOM, Basement of the Courthouse, in YOUNGSTOWN, in said County, on

Situated in the Township of Milton, County of Mahoning and State of Ohio:

Known as being a part of the north half of Great Lot 17, Milton Township, Mahoning County, Ohio and part of property formerly described in Volume 1510, Page 100 and O.R. 3043, Page 256 and more particularly desccribed as follows:

Beginning at the Northwest corner of Great Lot 17: thence N 89° 39' 24" E, along the centerline of Creed Road, a distance of 1763.09 feet to a railroad spike found and the true point of beginning of the parcel herein described; thence N 89° 39' 24" E. (basis of bearing) along said centerline, a distance of 125.00 feet to a railroad spike set; thence S 0° 12' 55" W. and passing over a 5/8" capped rebar set at 20.00 feet and along lands now or formerly owned by D.R. & L.S. Kohn as recorded in Volume 1510, Page 100 a total distance of 745.00 feet to a 5/8": capped rebar set; thence S 89° 39'; 24" W along said lands of D.R. and L.S. Kohn, and lands now or formerly owned by D. R. Kohn, as recorded in O.R. 3043, Page 256, a distance of 438.05 feet to a 5/8" capped rebar set; thence N 0° 01' 08" E along said lands of D.R. Kohn, a distance of 405.00 feet to a 5/8" capped rebar set; thence N 89° 39' 24" E along said lands of D.R. Kohn, a distance of 310.00 feet to a 5/8" capped rebar set; thence N 0° 01' 08" E along said lands of D.R. Kohn, a distance of 340.00 feet to the centerline of Creed Road and place of beginning and containing within said bounds 5.046 acres of land, of which 0.057 acres is located in the road right of way, be the same more or less, but subject to all legal highways and easements on record.

AND BEING FURTHER KNOWN FOR STREET NUMBERING PURPOSES AS: 15151 Creed Rd, Diamond, Ohio 44412.

PERMANENT PARCEL NUMBERS: 51-107-0-003.010 and 51-107-0-007.010

APPRAISED VALUE: $249,000.00.

Terms of Sale: Deposit in the form of a CERTIFIED CHECK as follows: $2,000.00 if the appraised value is less than or equal to $10,000.00; $5,000.00, if the appraised value is between $10,000.00 and $200,000.00 or $10,000.00 if the appraised value is greater than $200,000.00 (No deposit if Plaintiff is the Purchaser), balance in full within thirty (30) days from THE CONFIRMATION OF SALE.

AND if this sale results in a NO BID/NO SALE and remains unsold after this first sale, then this property shall be offered again at a second sale and shall be sold to the highest bidder without regard to the minimum bid requirement in section 2329.20. (ORC 2329.52(B), ORC 2329.26 (2)(a)(v)).

The purchaser shall be responsible for those costs, allowances and taxes that the proceeds of the sale are insufficient to cover. (ORC 2329.52(B)).

Sheriff's Sales may be canceled due to inclement weather or other county emergency. In such cases, the sale will be held upon the reopening of the Mahoning County Courthouse after the emergency has passed. Republication will not take place. However, notice of the new sale dates will be posted on the internet.
