By virtue of an Order of Sale issued from the Court of Common Pleas of MAHONING County, Ohio, and to me directed and delivered, I will offer for sale IN THE COMMISSIONERS' HEARING ROOM, Basement of the Courthouse, in YOUNGSTOWN, in said County, on

Situated in the Township of Smith, County of Mahoning and State of Ohio:

Known as and being a parcel of land situated in Section No. 9, Smith Township (T. 18, R-5), Mahoning County, State of Ohio and more fully described as follows: Beginning for reference at a monument found at the intersection of the centerlines of Bandy Road and Best Road; thence N 90° 00' 00"E (reference bearing) along the centerline of the Best Road a distance of 2842.74 feet to a point, said point being the true place of beginning of the parcel herein described; thence S 0° 15' 00" E a distance of 837.48 feet to a 5/8 inch iron pin set, but passing through a 5/8 inch iron pin set for reference at a distance of 30.00 feet; thence N 90° 00' 00"E a distance of 255.22 feet to a 5/8 inch iron pin set; thence S 0° 27' 24" W a distance of 153.00 feet to a 5/8 inch iron pin set; thence S 90° 00' 00" E a distance of 220.00 feet to a 5/8 inch iron pin set on the westerly line of lands of Melvin L and Anne Burkey, as recorded in O.R.V. 4160, Page 139, of the Mahoning County Deed Records; thence S 0° 27' 24"W along the westerly line of said Burkey lands a distance of 324.14 feet to a 5/8 inch iron pin found at the southwesterly corner of said Burkey lands, said pin also being on the northerly line of lands of Mary E. Stahl, as recorded in O.R.V. 5157, Page 2615, of the Mahoning County Deed Records; thence N 89° 50' 59" W along the northerly of said Stahl lands a distance of 480.50 feet to a 5/8 inch iron pin set; thence N 2° 30' 37" W a distance of 477.58 feet to a 5/8 inch iron pin set; thence N 0° 15' 00" W a distance of 837.48 feet to a point in the centerline of said Best Road, but passing through a 5/8 inch iron pin set for reference at a distance of 807.48 feet; thence N 90° 00' 00" E a distance of 30.00 feet to the place of beginning, containing 5.203 acres of land, more or less, of which 0.021 acres lies within the right-of-way of said Best Road; thence N 0° 15' 00" W a distance of 837.48 feet to a point in the centerline of said Best Road, but passing through a 5/8 inch iron pin set for reference at a distance of 807.48 feet; thence N 90° 00' 00" E a distance of 30.00 feet to the place of beginning, containing 5.203 acres of land, more or less, of which 0.021 acres lies within the right-of-way of said Best Road.

APPRAISED VALUE: $165,000.00.

Terms of Sale: Deposit in the form of a CERTIFIED CHECK as follows: $2,000.00 if the appraised value is less than or equal to $10,000.00; $5,000.00, if the appraised value is between $10,000.00 and $200,000.00 or $10,000.00 if the appraised value is greater than $200,000.00 (No deposit if Plaintiff is the Purchaser), balance in full within thirty (30) days from THE CONFIRMATION OF SALE.

AND if this sale results in a NO BID/NO SALE and remains unsold after this first sale, then this property shall be offered again at a second sale and shall be sold to the highest bidder without regard to the minimum bid requirement in section 2329.20. (ORC 2329.52(B), ORC 2329.26 (2)(a)(v)).

The purchaser shall be responsible for those costs, allowances and taxes that the proceeds of the sale are insufficient to cover. (ORC 2329.52(B)).

Sheriff's Sales may be canceled due to inclement weather or other county emergency. In such cases, the sale will be held upon the reopening of the Mahoning County Courthouse after the emergency has passed. Republication will not take place. However, notice of the new sale dates will be posted on the internet.
