By virtue of an Order of Sale issued from the Court of Common Pleas of MAHONING County, Ohio, and to me directed and delivered, I will offer for sale IN THE COMMISSIONERS' HEARING ROOM, Basement of the Courthouse, in YOUNGSTOWN, in said County, on

Situated in the Township of Austintown, County of Mahoning and State of Ohio:

And known as being a part of Great Lot No. 18 in said Austintown Township, and being more particularly bounded and described as follows:

Commencing at a monument found at the intersection of the centerline of Burgett Lane and the centerline of Burgett Road (County Road 279) aka the southerly line of Austintown Township; thence North 87° 58 '00" West along said centerline of Burgett Road a distance of 129.95 feet to the intersection of the southerly projection of the westerly line of Lot No. 60 in Orlando Plat No. 3 (Plat Volume 35, Page 114), said point being the Point of Beginning; thence North 87° 58' 00" West continuing along said centerline of Burgett Road aka the southerly line of said Austintown Township, a distance of 115.00 feet to the southeasterly corner of the lands of R.R. Morain (OR Book 5772, Page 2185) thence North 01°41' 00" East along the easterly line of said lands of Morain a distance of 375.00 feet to a 5/8" iron pin found at the southwesterly corner of Lot No. 278 in Replat of Lot Nos. 277 and 278 in Timber Lanes Plat No 5 (Plat Volume 51, Page 219) and passing over a 5/8" iron pin founds at 30.00 feet; thence South 87° 57' 00" East along said Lot No 278 and Lot No. 277 a distane of 123.19 feet to a 5/8 iron pin set; thence South 02° 56' 00" West along the westerly line of said Lot No. 277 and said Lot No 60 a distance of 375.00 feet to the true Point of Beginning (and passing over a 5/8 iron pin found at 345.00 feet) and containing 44,658.4329 square feet or 1.0252 acres of land, more or less.

The above described contains 0.0794 acres of land within the right-of-way limits of said Burgett Road; the same being the base azimuth of the above described parcel, Bearing: North 87° 58' 00" West. A survey of this parcel was performed by Warren F. Drescher IV, Registered Surveyor No. 7390, May 2010.

AND BEING FURTHER KNOWN FOR STREET NUMBERING PURPOSES AS: 4113 Burgett Road, Canfield, Ohio 44406.

PERMANENT PARCEL NUMBER: 48-111-0-006.000

APPRAISED VALUE: $102,500.00.

Terms of Sale: Deposit in the form of a CERTIFIED CHECK as follows: $2,000.00 if the appraised value is less than or equal to $10,000.00; $5,000.00, if the appraised value is between $10,000.00 and $200,000.00 or $10,000.00 if the appraised value is greater than $200,000.00 (No deposit if Plaintiff is the Purchaser), balance in full within thirty (30) days from THE CONFIRMATION OF SALE.

AND if this sale results in a NO BID/NO SALE and remains unsold after this first sale, then this property shall be offered again at a second sale and shall be sold to the highest bidder without regard to the minimum bid requirement in section 2329.20. (ORC 2329.52(B), ORC 2329.26 (2)(a)(v)).

The purchaser shall be responsible for those costs, allowances and taxes that the proceeds of the sale are insufficient to cover. (ORC 2329.52(B)).

Sheriff's Sales may be canceled due to inclement weather or other county emergency. In such cases, the sale will be held upon the reopening of the Mahoning County Courthouse after the emergency has passed. Republication will not take place. However, notice of the new sale dates will be posted on the internet.
