DEFENDANTS.

Unknown Surviving Spouse, Next of Kin, Devisees, Legatees, Executors, Administrators, and Personal Representatives if any, of Rosemarie Antonoff, Deceased, whose address is unknown and who cannot be served within the State of Ohio, will take notice that Premier Bank filed an Answer, Cross-Claim, and Counterclaim in the Court of Common Pleas of Mahoning County, Ohio on April 14, 2022 in Case No. 21CV 911, against Unknown Surviving Spouse, Next of  Kin, Devisees, Legatees, Executors, Administrators, and Personal Representatives, if any, of Rosemarie Antonoff Deceased, et al., Defendants, alleging that on or about February 22, 2013, The Home Savings and Loan Company of Youngstown, Ohio, extended a loan to Michael R. Antonoff and Rosemarie Antonoff, both of whom are now deceased; that Michael R. Antonoff and Rosemarie Antonoff executed and delivered to The Home Savings and Loan Company of Youngstown, Ohio a  certain Consumer Real Estate Secured Balloon Note ("the Note"), in the amount of $116,500.00, a true copy of which is attached to the Answer, Cross-Claim, and Counterclaim as Exhibit "B", that Cross-Claimant Premier Bank is the holder of the Note, upon which there is due and owing to Cross-Claimant Premier Bank $100,433.90, plus interest from January 29, 2020 at the rate of 4.00% per annum, unpaid late charges, and any other costs and expenses recoverable under the Note and the mortgage; that to secure payment of the Note, Michael R. Antonoff and Rosemarie Antonoff granted The Home Savings and Loan Company of Youngstown, Ohio a Mortgage, and thereby conditionally conveyed to The Home Savings and Loan Company of Youngsotwn, Ohio the real property described therein, and known as and located at 2990 Whispering Pines Drive, Canfield, Ohio 44406, Parcel No. 48-103-0-029.000; that the Mortgage was recorded  in O.R. Book 6013, Page 2125, Mahoning County Records, a true copy of which is attached to the Answer, Cross-Claim, and Counterclaim as Exhibit "C"; that the Mortgage is the first and best lien against the subject real estate, after the lien of Plaintiff for real estate taxes; that the Note secured by the Mortgage is in default for lack of payment, the conditions of the Mortgage have been broken, Cross-Claimant Premier Bank is the holder of the Mortgage and is entitled to have the Mortgage foreclosed; that Plaintiff holds a claim on the subject real estate for real estate taxes; that Defendants Unknown Surviving Spouse, Next of Kin, Devisees, Legatees, Executors, Administrators and Personal Representatives, if any, of Rosemarie Antonoff Deceased, Cynthia Cerimele, Next of Kin of Rosemarie Antonoff, Deceased, Unknown Spouse, if any, of Cynthia Cerimele, Michael D. Antonoff, Unknown Spouse, if any, of Michael D. Antonoff, D & L Leasing Corp., and State of Ohio Department of Job & Family Services may have or claim to have interests in the subject real estate. The Answer, Cross-Claim, and Counterclaim demands that the Defendants named therein be required to appear in this suit and set forth whatever interests they may have in and to the subject real property or be forever barred from asserting the same; that Cross-Claimant Premier Bank obtain judgment in foreclosure; that the subject premises be appraised and sold in this action, and the proceeds applied to the satisfaction of Cross-Claimant Premier Bank's Mortgage in its proper priority; and that the Court grant such other and further relief as equity and the nature of the case may require.

Defendants Unknown Surviving Spouse, Next of Kin, Devisees, Legatees, Executors, Administrators and Personal Representatives, if any of Rosemarie Antonoff, Deceased is further notified that they are required to answer said Complaint within twenty-eight (28) days of the last publication of this notice, said answer day being the 28th day of June, 2022 and set forth whatever interest they may have in and to the above-described real estate or be forever barred from asserting the same.
