DEFENDANTS.

To the Defendants: Unknown Heirs, Legatees, and Devisees, if any, of Ellamarie R. Moreland and Donald Robinson, whose address is unknown:

Plaintiff has brought this action naming Unknown Heirs, Legatees and Devisees, if any, of Ellamarie R. Moreland and Donald Robinson as Defendants in the above-named court by filing its Complaint on June 24, 2024.

The object of the Complaint is to foreclose the mortgage against Defendants. The prayer is that Plaintiff be found to have a good and valid first lien on the within described premises in the amount as set forth in the Complaint and accrued interest and penalties, if any; that each of the Defendants be required to answer setting up their interest, if any, in said premises, or be forever barred from asserting same; that unless the amount found due the Plaintiff be paid within a reasonable time to  be named by the Court, the equity of redemption of said Defendants shall be foreclosed, and an Order of Sale issued to the Plaintiff for it to  be directed to sell said premises as upon execution, and for such other relief as Plaintiff may be entitled.

Situated in the Township of Smith, Town 18, Range 5 of the Seven Ranges, County of Mahoning and State of Ohio and known as being part of the Northeast quarter of Section 7 of the said Township and further bounded and described as follows:

Commencing at a monument assembly found (2 1/2 stamped Mahoning County disc) at the centerline intersection of North Benton West Road (60' R/W) and Oyster Road (60' R/W);

Thence South 0° 02' 24" East, along the centerline of said Oyster Road, a distance of 2557.94 feet to a 3/4" iron rod found at the Northwest corner of the Northeast quarter section of Section 7;

Thence South 0° 00' 43" East, along said road centerline and quarter section line a distance of 413.34 feet to a point and a Northwest comer of lands conveyed to C. Van Camp by Volume 5566, Page 855 of Mahoning County Official Records, said point being the true point of beginning for the parcel herein described;

Thence North 89° 28' 31" East; long the South line of said Van Camp and passing over a 5/8" re bar found at 30.02 feet, a distance of 1154.46 feet to a 5/8" capped "A Szuch" rebar found at the Southeast corner thereof and on the West line lands conveyed to Big Muddy Acres, Inc. by Volume 5228, Page 2268 of Mahoning County Official Records;

Thence South 0° 00' 43" East, along a West line of said Big Buddy Acres, a distance of 206.67 feet to a 5/8" rebar found at the Northeast corner of lands conveyed to T. Lilley by Volume 2996, Page 243 of Mahoning County Official Records;

Thence South 89° 28' 31" West along the North line of said Lilley and passing over a 5/8" capped "A Szuch" rebar found at 1124.46 feet, a distance of 1154.46 feet a point on said road centerline and quarter section line;

Thence North 0° 00' 43" West, along said road centerline and quarter section line, a distance of 206.67 feet to the true point of beginning and containing 5.4771 acres of land (0.1423 acres in road right-of-way) as surveyed in June, 2013 by Clifford H. McGuire, Professional Surveyor No. 7770.

The basis of bearing for the centerline of Oyster Road was taken from the Deed of Record O.R. 5978-651 to Mark Wright. This description was pursuant to an actual field survey performed 7/1/2013.

You are required to answer the Complaint within twenty-eight days after the last publication of this notice, which will be published once each week for three successive weeks, and the last publication will be made on  July 26, 2024, said answer day being the 23rd day of August 2024.

In case of your failure to answer or otherwise respond as permitted by the Ohio Rules of Civil Procedure within the time stated, judgment by default will be rendered against you for the relief demanded in the complaint.
