By virtue of an Order of Sale issued from the Court of Common Pleas of MAHONING County, Ohio, and to me directed and delivered, I will offer for sale IN THE COMMISSIONERS' HEARING ROOM, Basement of the Courthouse, in YOUNGSTOWN, in said County, on

Commencing from a monument found (JA-24) on the intersection of the centerlines of Lipkey Road (60' R/W) and New Road (50' R/W); Thence North 09 degrees 46 minutes 36 seconds East, a distance of 3694.67 feet to the TRUE POINT OF BEGINNING: Thence North 09 degrees 28 minutes 28 seconds East, along said centerline of Lipkey Road, a distance of 908.38 feet to a point on the centerline of Lipkey Road; Thence South 84 degrees 21 minutes 13 seconds East, along the southerly Right-of-Way line of Mahoning Avenue, SR 18, (R/W varies), passing over an iron pin set at 30.0 feet, a total distance of 673.94 feet to an iron pin set; Thence containing along said southerly Right-of-Way line of Mahoning Avenue, on a curve to the right, having a radius of 2814.79 feet, an arc length of 209.85 feet, a chord bearing of South 72 degrees 59 minutes 23 seconds East, and being 209.80 feet in chord length to an iron pin set on the westerly line of Lands Now or Formerly of M & R Taylor as found recorded in Official Record 5826, at Page 2415 of the Mahoning County Record of Deeds; Thence South 00 degrees 17 minutes 58 seconds East along said westerly line of Lands of Taylor, a distance of 698.93 feet to an iron pin found on the southwest corner of said Lands of Taylor; Thence South 00 degrees 13 minutes 00 seconds East, along a westerly line of Lands Now or Formerly of P C Fire, as found recorded in Official Record 4602, at Page 6119, in the Mahoning County Records of Deeds, a distance of 50.55 feet to an iron pin found (AES) on a northerly line of said Lands of Fire; Thence North 89 degrees 22 minutes 32 seconds West, along said northerly line of Lands of Fire, a distance of 240.40 feet to an iron pin found (AES) on the northwest corner of said Lands of Fire; Thence South 00 degrees 18 minutes 51 seconds East, along the westerly line of said Lands of Fire, a distance of 30.00 feet to an iron pin found on the northeast corner of Lands Now and Formerly of C M Kalinich, as found recorded in Official Record 5664, at Page 2302 of the Mahoning County Record of Deeds; Thence North 89 degrees 22 minutes 32 seconds West, along the northerly line of said Lands of Kalinich, passing over an iron pin found (5/8") on the easterly Right-of-Way line of Lipkey Road (60' R/W) at 754.12 feet, a total distance of 784.48 feet to the True Point of Beginning and containing 18.510 acres of land, of which 0.625 acres are in Right-of-Way.

The Basis of Bearing being the easterly line of the Interstate Motor Freight System Plat No. 1 held at South 00 degrees 13 minutes 00 seconds East, as recorded in Volume 52, at Page 166 of the Mahoning County Record of Plats.

The above-described parcel has been surveyed under the supervision of James J. Mahoney, Professional Surveyor No. 8076 of AES Surveying and Land Planning Inc on September 25, 2017, but subject to all legal highways and easements of record.

All iron pins set are 5/8" rebar, 30 inches in length with I.D. cap S-8076.

APPRAISED VALUE: $159,000.00.

Terms of Sale: Deposit in the form of a CERTIFIED CHECK as follows: $2,000.00 if the appraised value is less than or equal to $10,000.00; $5,000.00, if the appraised value is between $10,000.00 and $200,000.00 or $10,000.00 if the appraised value is greater than $200,000.00 (No deposit if Plaintiff is the Purchaser), balance in full within thirty (30) days from THE CONFIRMATION OF SALE.

AND if this sale results in a NO BID/NO SALE and remains unsold after this first sale, then this property shall be offered again at a second sale and shall be sold to the highest bidder without regard to the minimum bid requirement in section 2329.20. (ORC 2329.52(B), ORC 2329.26 (2)(a)(v)).

The purchaser shall be responsible for those costs, allowances and taxes that the proceeds of the sale are insufficient to cover. (ORC 2329.52(B)).

Sheriff's Sales may be canceled due to inclement weather or other county emergency. In such cases, the sale will be held upon the reopening of the Mahoning County Courthouse after the emergency has passed. Republication will not take place. However, notice of the new sale dates will be posted on the internet.
