By virtue of an Order of Sale issued from the Court of Common Pleas of MAHONING County, Ohio, and to me directed and delivered, I will offer for sale IN THE COMMISSIONERS' HEARING ROOM, Basement of the Courthouse, in YOUNGSTOWN, in said County, on

TUESDAY, NOVEMBER 27, A.D. 2018 AND

TUESDAY, DECEMBER 11, A.D. 2018

at 1:30 o'clock P. M. of said day, the following described lands and tenements, to-wit:

PARCEL NO. 1

Situated in the Township of Coitsville, County of Mahoning and State of Ohio:

And known as being a part of Great Lot No. 12 and further known as being Lot Number 12 in Hazeland Plat Number 4 as contained in Mahoning County Records of Plats Volume 32, Page 284 and being more particularly described as follows:

Said Lot Number 12 has a frontage of 100 feet on the South Side of Oak Street Extension and extends back therefrom between parallel lines a distance of 405.6 feet, be the same more or less but subject to all legal highways.

PARCEL NO. 2

Situated in the Township of Coitsville, County of Mahoning and State of Ohio:

And known as being a part of Great Lot No. 12 and further known as being Lot Number 13 in Hazel and Plat Number 4 as contained in Mahoning County Records of Plats Volume 32, Page 284 and being more particularly described as follows:

Said Lot Number 13 has a frontage of 100 feet on the South Side of Oak Street Extension and extends back therefrom between parallel lines a distance of 405.6 feet, be the same more or less, but subject to all legal highways.

Situated in the Township of Coitsville, County of Mahoning and State of Ohio:

Situated in Great Lot No. 12 of Coitsville Township, Mahoning County, Ohio. Beginning at a point in the center line of Oak Street Extension said point being South 87 degrees 0' East a distance of 500.00 feet from the intersection of the center lines of the Hubbard Lowellville Road and Oak Street Extension; thence South 87 degrees 0 minutes East along the center line of Oak Street Extension a distance of 100.00 feet to a point; thence South 2 degrees 16 feet West as a distance of 435.60 feet to an iron pin; North 87 degrees 0 feet West a distance of 100.00 feet to an iron pin; thence North 2 degrees 16 feet East a distance of 435.60 feet to the point and place of beginning and containing 1.00 acre of land be the same more or less, but subject to all legal highways.

This conveyance is made to the following restrictions:

Said real estate shall be used exclusively for private dwelling house purposes; and no such house shall be erected, placed or suffered to remain upon siad premises, being less than four rooms of double construction, the front of which house shall be set back at least 130 feet from the center line of the road. No place of public entertainment, apartment house, flat, boarding house, trailer, nor building designed for the residence of more than one family; and no hotel, tavern, dance hall, resort of business of any other nature shall be established, conducted, maintained or suffered to remian upon said premises. It is further agreed that no structure shall be used or occupied as a residence other than a completed single residence dwelling built in compliance with the foregoing restrictions.

AND BEING FURTHER KNOWN FOR STREET NUMBERING PURPOSES AS: 5373 Oak Street, Lowellville, Ohio 44436.

PERMANENT PARCEL NUMBERS: 42-038-0-006.00, 42-038-0-007.00 and 42-038-0-008.00

APPRAISED VALUE: $52,320.00.

Terms of Sale: Deposit in the form of a CERTIFIED CHECK as follows: $2,000.00 if the appraised value is less than or equal to $10,000.00; $5,000.00, if the appraised value is between $10,000.00 and $200,000.00 or $10,000.00 if the appraised value is greater than $200,000.00 (No deposit if Plaintiff is the Purchaser), balance in full within thirty (30) days from THE CONFIRMATION OF SALE.

AND if this sale results in a NO BID/NO SALE and remains unsold after this first sale, then this property shall be offered again at a second sale and shall be sold to the highest bidder without regard to the minimum bid requirement in section 2329.20. (ORC 2329.52(B), ORC 2329.26 (2)(a)(v)).

The purchaser shall be responsible for those costs, allowances and taxes that the proceeds of the sale are insufficient to cover. (ORC 2329.52(B)).

Sheriff's Sales may be canceled due to inclement weather or other county emergency. In such cases, the sale will be held upon the reopening of the Mahoning County Courthouse after the emergency has passed. Republication will not take place. However, notice of the new sale dates will be posted on the internet.
