By virtue of an Order of Sale issued from the Court of Common Pleas of MAHONING County, Ohio, and to me directed and delivered, I will offer for sale IN THE COMMISSIONERS' HEARING ROOM, Basement of the Courthouse, in YOUNGSTOWN, in said County, on

Situated in the Austintown Township, County of Mahoning and State of Ohio:

Known as being Part of Great Lot No. 19 in said Austintown Township, and being further bounded and described as follows:

Commencing at a monument found on the centerline of Raccoon Road (County Road 109), said point being located South 00° 27' 00" east a distance of 27.43 feet from the intersection with the centerline of Kirk Road (a sixty (60) foot right-of-way County Road 146); Thence North 00° 27' 00" West along said centerline of Kirk Road a distance of 27.43 feet to the intersection with said centerline of Kirk Road; Thence North 86° 45' 40" West along said centerline of Kirk Road a distance of 991.14 feet to a point of deflection of said centerline; Thence North 89° 46' 40" West continuing along said centerline of Kirk Road a distance of 1276.36 feet to the Point of Beginning, said point being the northwesterly corner of the lands of G.F. Srock (O.R. Book 2494, Page 229); Thence South 00° 03' 00" East along the westerly line of said lands of Srock a distance of 469.60 feet to a 5/8" iron pin found on the northerly line of Lot No. 41 in the Brookewood Plat No. 13 (Plat Volume 63, Page 145), and passing over a 5/8" iron pin found at 30.00 feet: Thence North 89° 46' 40" West along the northerly line of Brookewood Plat a distance of 223.20 feet to a 5/8" iron pin found on the easterly line of the westerly portion of a Vacated Fifty (50) foot street, as shown in the Dalton Plat (Plat Volume 22, Page 184); Thence North 00° 03' 00" West along said Vacated Street a distance of 469.40 feet to a point on said centerline of Kirk Road, and passing over a 5/8" iron pin found at 439.60 feet; Thence South 89° 46' 40" East along said centerline of Kirk Road a distance of 223.20 feet to the true POINT of BEGINNING and containing 104,813.5382 square feet or 2.4062 acres of land, more or less.

The above described parcel contains 0.1537 acres of land within the right-of-way limits of said Kirk Road; the same being the base azimuth of the above described parcel, bearing South 89° 46' 40" East.

A Survey of this parcel was performed by Warren F. Drescher IV Registered Surveyor No. 7390; May 2006.

AND BEING FURTHER KNOWN FOR STREET NUMBERING PURPOSES AS: 4677 Kirk Road, Austintown, Ohio 44515.

PERMANENT PARCEL NUMBER: 48-022-0-016.000

APPRAISED VALUE: $162,000.00.

Terms of Sale: Deposit in the form of a CERTIFIED CHECK as follows: $2,000.00 if the appraised value is less than or equal to $10,000.00; $5,000.00, if the appraised value is between $10,000.00 and $200,000.00 or $10,000.00 if the appraised value is greater than $200,000.00 (No deposit if Plaintiff is the Purchaser), balance in full within thirty (30) days from THE CONFIRMATION OF SALE.

AND if this sale results in a NO BID/NO SALE and remains unsold after this first sale, then this property shall be offered again at a second sale and shall be sold to the highest bidder without regard to the minimum bid requirement in section 2329.20. (ORC 2329.52(B), ORC 2329.26 (2)(a)(v)).

The purchaser shall be responsible for those costs, allowances and taxes that the proceeds of the sale are insufficient to cover. (ORC 2329.52(B)).

Sheriff's Sales may be canceled due to inclement weather or other county emergency. In such cases, the sale will be held upon the reopening of the Mahoning County Courthouse after the emergency has passed. Republication will not take place. However, notice of the new sale dates will be posted on the internet.
