By virtue of an Order of Sale issued from the Court of Common Pleas of MAHONING County, Ohio, and to me directed and delivered, I will offer for sale IN THE COMMISSIONERS' HEARING ROOM, Basement of the Courthouse, in YOUNGSTOWN, in said County, on

at 1:30 o'clock P. M. of said day, the following described lands and tenements, to-wit:

Situated in the Township of Canfield, County of Mahoning and State of Ohio:

And known as Lot Number Three (3) of the G. A. Wiant Replat Number One (1) as recorded in Volume 38 of Maps, Page 66; Mahoning County Records.

Said Lot Number Three (3) of the G. A. Wiant Replat Number One (1) has a frontage of One Hundred (100) feet on the South line of Sleepy Hollow Drive and extends back on its West line Two Hundred Sixty Two and Seven-Tenths (262.7) feet and extends back on its East line Two Hundred Sixty-two and Seven-Tenths (262.7) feet and has a rear line of One Hundred (100) feet as shown by said plat.

This conveyance is made and accepted by the Grantees subject to the following covenants, conditions and restrictions:

A. No building shall be constructed out of cement blocks where the cement blocks are used for exterior construction above the first floor joists.

B. No buidings shall be build with a flat roof.

C. All houses are to be Sixty feet or more in length. This length may include an attached garage or breezeway.

D. The house to be build on this Lot is to have Thirteen Hundred (1300) square feet or more of finished floor area, excluding basements, garages, porches and breezeways, and will be a one floor, ranch type house with a basement.

E. The front exterior construction of said house shall have twenty-five percent or more of its surface brick, stone or perma-stone.

Be the same, more or less but subject to all legal highways.

AND BEING FURTHER KNOWN FOR STREET NUMBERING PURPOSES AS: 31 Sleepy Hollow Drive, Canfield, Ohio 44406-1056.

APPRAISED VALUE: $148,000.00.

Terms of Sale: Deposit in the form of a CERTIFIED CHECK as follows: $2,000.00 if the appraised value is less than or equal to $10,000.00; $5,000.00, if the appraised value is between $10,000.00 and $200,000.00 or $10,000.00 if the appraised value is greater than $200,000.00 (No deposit if Plaintiff is the Purchaser), balance in full within thirty (30) days from THE CONFIRMATION OF SALE.

AND if this sale results in a NO BID/NO SALE and remains unsold after this first sale, then this property shall be offered again at a second sale and shall be sold to the highest bidder without regard to the minimum bid requirement in section 2329.20. (ORC 2329.52(B), ORC 2329.26 (2)(a)(v)).

The purchaser shall be responsible for those costs, allowances and taxes that the proceeds of the sale are insufficient to cover. (ORC 2329.52(B)).

Sheriff's Sales may be canceled due to inclement weather or other county emergency. In such cases, the sale will be held upon the reopening of the Mahoning County Courthouse after the emergency has passed. Republication will not take place. However, notice of the new sale dates will be posted on the internet.
