By virtue of an Order of Sale issued from the Court of Common Pleas of MAHONING County, Ohio, and to me directed and delivered, I will offer for sale IN THE COMMISSIONERS' HEARING ROOM, Basement of the Courthouse, in YOUNGSTOWN, in said County, on

at 1:30 o'clock P. M. of said day, the following described lands and tenements, to-wit:

Parcel 1:

Situated in the City of Youngstown, County of Mahoning and State of Ohio, and known as part of Youngstown City Out-lot No. 1106, said Out-lot being part of Great Lot No. 6, and described as follows:

Beginning at a point in the corner line of Volney Road, which point is south 9 degrees 47' west approximately Five hundred and no-tenths (500.0) feet measured along the center line of Volney Road from a point at the intersection of the center line of Volney Road and the center line of County Road, known as Cohasset Road; thence continuing along the center line of Volney Road south 9 degrees 47' west, 20 feet to an angle in said Volney Road; thence continuing along the center line of Volney Road south 21 degrees 19' west, One Hundred and Twenty-eight (128) feet to a point on said center line; thence south 87 degrees 25' east, three Hundred and Thirty-five and forty-nine hundredths (335.49) feet to a point; thence North 14 degrees 13' east, One Hundred (100) feet to a point; thence north 79 degrees 33' west, three hundred and fifteen (315) feet to the place of beginning, and containing about Ninty-four Hundredths (.94) acres of land.

Situated in the City of Youngstown, County of Mahoning and State of Ohio, and being known as part of Youngstown City Out Lot Nos. 396 and 1106. Said part of Out Lot No. 1106 is bounded and described as follows:

Beginning at a point where the north line of the lands heretofore conveyed to Florence McKelvey Clegg intersects the center line of Volney Road, thence along the north line of lands of Florence McKelvey Clegg's 79 degrees 38 E 314.87 feet; thence N 11 degrees 39' E 56.08 feet to north line of Out Lot 1106; thence along north line of Out Lot 1106 N 72 degrees 09' W 32.04 feet to center line of Volney Road; thence along center line of Volney Road S 9 degrees 42' W 85.81 feet to place of beginning, and containg 0.517 acres.

Said part of Out Lot 396 is bounded and described as follows:

Beginning at a point in the center line of Volney Road where south line of Out Lot 396 intersects said center line; thence along the south line of Out Lot 395 S 72 degrees 9' E 320.04 feet; thence N 11 degrees 39' E 44.22 feet; thence north 70 degrees 14' W 323.46 feet to center line of Volney Road; thence along center line of Volney Road S 9 degrees 42' W 67.5 feet to place of beginning and containing 0.413 acres, be the same more or less, but subject to all legal highways.

AND BEING FURTHER KNOWN FOR STREET NUMBERING PURPOSES AS: 1904 Volney Road, Youngstown, Ohio 44511.

APPRAISED VALUE: $74,000.00.

Terms of Sale: Deposit in the form of a CERTIFIED CHECK as follows: $2,000.00 if the appraised value is less than or equal to $10,000.00; $5,000.00, if the appraised value is between $10,000.00 and $200,000.00 or $10,000.00 if the appraised value is greater than $200,000.00 (No deposit if Plaintiff is the Purchaser), balance in full within thirty (30) days from THE CONFIRMATION OF SALE.

AND if this sale results in a NO BID/NO SALE and remains unsold after this first sale, then this property shall be offered again at a second sale and shall be sold to the highest bidder without regard to the minimum bid requirement in section 2329.20. (ORC 2329.52(B), ORC 2329.26 (2)(a)(v)).

The purchaser shall be responsible for those costs, allowances and taxes that the proceeds of the sale are insufficient to cover. (ORC 2329.52(B)).

Sheriff's Sales may be canceled due to inclement weather or other county emergency. In such cases, the sale will be held upon the reopening of the Mahoning County Courthouse after the emergency has passed. Republication will not take place. However, notice of the new sale dates will be posted on the internet.
