By virtue of an Order of Sale issued from the Court of Common Pleas of MAHONING County, Ohio, and to me directed and delivered, I will offer for sale IN THE COMMISSIONERS' HEARING ROOM, Basement of the Courthouse, in YOUNGSTOWN, in said County, on

Situated in the Village of New Springfield and Township of Springfield, County of Mahoning and State of Ohio:

Known as being Lot No. 2 in the Replat of R. E. and L. H. Howard Plat No. 1 as recorded in Volume 115, at Page 245 of the Mahoning County Record of Plats.

Part of the southwest quarter of Section 29, Township 9 (Springfield), Range 1, Mahoning County, Ohio described as follows: Commencing at a monument found at the intersection of Woodworth Road (S.R. 165) and Springfield Road; Thence a bearing of South 45 degrees 26 minutes 13 seconds East a distance of 1572.26 to a corner; Thence with the southwesterly line of Woodworth Road a bearing of South 43 degrees 14 minutes 38 seconds East a distance of 120.37 feet to a corner; Thence with the southeasterly line of Oak Alley and a projection thereof a bearing of South 47 degrees 03 minutes 59 seconds West a distance of 225.75 feet to an iron pin found at the point of beginning of a 20-foot ingress/egress easement; Thence through lands of R. H. and L. H. Howard and being 10 feet right and left to the following described centerline: 1. A bearing of South 89 degrees 52 minutes 22 seconds West a distance of 10.00 feet to a corner; 2. A bearing of South 00 degrees 07 minutes 38 seconds East a distance of 30.98 feet to a corner; 3. A bearing of South 61 degrees 35 minutes 54 seconds West a distance of 255.22 feet to a corner; 4. A bearing of North 82 degrees, 54 minutes 27 seconds West a distance of 185.40 feet to the terminus of said easement; Being part of the premises conveyed to the within Grantor as recorded and described in Volume 1258, Page 268 of the Mahoning County Recorder's Office, Courthouse, Youngstown, Ohio. Subject to pertinent public and private rights of way and easements. Reference bearing: South 43 degrees 14 minutes 38 seconds East assumed, South 42 degrees 53 minutes and 00 seconds East Survey Record.

Iron pin set denotes 5/8-inch diameter 30 inch length rebar with I.D. cap. Surveyed and described by David.

APPRAISED VALUE: $129,000.00.

Terms of Sale: Deposit in the form of a CERTIFIED CHECK as follows: $2,000.00 if the appraised value is less than or equal to $10,000.00; $5,000.00, if the appraised value is between $10,000.00 and $200,000.00 or $10,000.00 if the appraised value is greater than $200,000.00 (No deposit if Plaintiff is the Purchaser), balance in full within thirty (30) days from THE CONFIRMATION OF SALE.

AND if this sale results in a NO BID/NO SALE and remains unsold after this first sale, then this property shall be offered again at a second sale and shall be sold to the highest bidder without regard to the minimum bid requirement in section 2329.20. (ORC 2329.52(B), ORC 2329.26 (2)(a)(v)).

The purchaser shall be responsible for those costs, allowances and taxes that the proceeds of the sale are insufficient to cover. (ORC 2329.52(B)).

Sheriff's Sales may be canceled due to inclement weather or other county emergency. In such cases, the sale will be held upon the reopening of the Mahoning County Courthouse after the emergency has passed. Republication will not take place. However, notice of the new sale dates will be posted on the internet.
