TUESDAY, SEPTEMBER 19, A.D. 2017

at 1:30 o'clock P. M. of said day, the following described lands and tenements, to-wit:
Situated in the Township of Smith, County of Mahoning and State of Ohio, and being part of the Northwest Quarter, Section 5, Township 18, Range 5 of Smith Township and being all of tract of land transferred to Richard A. Sabina, as recorded in OR 5784, Page 331, and further described as follows to wit:
Beginning at a monument box found at the centerline intersection of Martin Road - 60' r/w - and North Benton West Road - 60' r/w;
Thence North 89° 52' 53" East, along the centerline of aforesaid North Benton West Road (which is also the quarter section line), a distance of 1478.03 feet to a point, which is the true place of beginning for the property herein described;
1. Thence North 00° 02' 13" East, along the east line of a tract of land now or formerly owned by Danny L. Gajovski, Sr. (OR 6103, Page 2423), (and passing over a 5/8" iron bar found at a distance of 30.28 feet), a total distance of 1036.55 feet to a 5/8" iron bar found;
2. Thence North 89° 52' 14" East, along the south line of a tract of land now or formerly owned by Dana R. Greenawalt (OR 5932, Page 921), a distance of 211.04 feet to a 5/8" iron bar found;
3. Thence South 00° 02' 37" West, along the west line of a tract of land now or formerly owned by Robert A. Warren (OR 5516, Page 1793), (and passing over a 5/8" iron bar found at a distance of 1006.26 feet), a total distance of 1036.59 feet to a point in the centerline of the aforesaid North Benton West Road;
4. Thence South 89° 52' 53" West, along the centerline of aforesaid North Benton West Road (which is also the quarter section line), a distance of 210.92 feet to the true place of beginning of the herein described parcel.
Containing 5.0205 acres of land, based on a field survey by Beth A. Pearson, P. S. 8430, in November 2014.
The basis of bearing of North 89° 52' 53" East, for the centerline of North Benton West Road, was taken from the L. R. Beaver Survey dated March 2010.
NOTE: Notwithstanding the reference to acreage or square footage in the description set forth in Schedule A hereof, this policy does not insure nor guarantee the acreage or quantity of land set therein.
AND BEING FURTHER KNOWN FOR STREET NUMBERING PURPOSES AS: 21754 North Benton West Road, North Benton, Ohio 44449.
PERMANENT PARCEL NUMBER: 16-182-0-001.080
APPRAISED VALUE: $123,000.00.
Terms of Sale: Deposit in the form of a CERTIFIED CHECK as follows: $2,000.00 if the appraised value is less than or equal to $10,000.00; $5,000.00, if the appraised value is between $10,000.00 and $200,000.00 or $10,000.00 if the appraised value is greater than $200,000.00 (No deposit if Plaintiff is the Purchaser), balance in full within thirty (30) days from THE CONFIRMATION OF SALE.
AND if this sale results in a NO BID/NO SALE and remains unsold after this first sale, then this property shall be offered again at a second sale and shall be sold to the highest bidder without regard to the minimum bid requirement in section 2329.20. (ORC 2329.52(B), ORC 2329.26 (2)(a)(v)).
The purchaser shall be responsible for those costs, allowances and taxes that the proceeds of the sale are insufficient to cover. (ORC 2329.52(B)).
Sheriff's Sales may be canceled due to inclement weather or other county emergency. In such cases, the sale will be held upon the reopening of the Mahoning County Courthouse after the emergency has passed. Republication will not take place. However, notice of the new sale dates will be posted on the internet.
