By virtue of an Order of Sale issued from the Court of Common Pleas of MAHONING County, Ohio, and to me directed and delivered, I will offer for sale IN THE COMMISSIONERS' HEARING ROOM, Basement of the Courthouse, in YOUNGSTOWN, in said County, on

at 1:30 o'clock P. M. of said day, the following described lands and tenements, to-wit:

Situated in the Township of Berlin, County of Mahoning and State of Ohio:

AND KNOWN AS BEING parts of Great Lot No. 27 and Great Lot No. 28 of Tract No. 2 and part of Great Lot No. 9 of Tract No. 1 of said township, and more fully described as follows:

BEGINNING AT A POINT in the Northerly margin of the Akron-Canfield Road, which point is Easterly about 148.5 feet from the East line of Great Lot No. 9, Tract 1, and North 30 feet from the centerline of the Akron-Canfield Road, said point of beginning also being the Southwest corner of 93.5 acre tract of land now or formerly owned by G.B. and G. Ellis;

thence Northerly along the Westerly line of said Ellis lands, a distance of 1882 feet to a point;

thence Westerly through Great Lots 27 and 28, Tract 2, and parallel to the Northerly margin of the Akron-Canfield Road, a distance of 258 feet to a point in Great Lot 28, Tract 2;

thence Southerly through Great Lot 28, Tract 2, and Great Lot 9, Tract 1, a distance of 1882 feet to a point in the Northerly margin of the Akron-Canfield Road; thence Easterly along the Northerly margin of the Akron-Canfield Road, a distance of 268 feet to the place of beginning and containing 11.363 acres of land, be the same more or less, but subject to all legal highways, conditions, restrictions and easements of record.

AND BEING FURTHER KNOWN FOR STREET NUMBERING PURPOSES AS: 16160 Akron-Canfield Road, Berlin Center, Ohio 44401.

APPRAISED VALUE: $39,000.00.

Terms of Sale: Deposit in the form of a CERTIFIED CHECK as follows: $2,000.00 if the appraised value is less than or equal to $10,000.00; $5,000.00, if the appraised value is between $10,000.00 and $200,000.00 or $10,000.00 if the appraised value is greater than $200,000.00 (No deposit if Plaintiff is the Purchaser), balance in full within thirty (30) days from THE CONFIRMATION OF SALE.

AND if this sale results in a NO BID/NO SALE and remains unsold after this first sale, then this property shall be offered again at a second sale and shall be sold to the highest bidder without regard to the minimum bid requirement in section 2329.20. (ORC 2329.52(B), ORC 2329.26 (2)(a)(v)).

The purchaser shall be responsible for those costs, allowances and taxes that the proceeds of the sale are insufficient to cover. (ORC 2329.52(B)).

Sheriff's Sales may be canceled due to inclement weather or other county emergency. In such cases, the sale will be held upon the reopening of the Mahoning County Courthouse after the emergency has passed. Republication will not take place. However, notice of the new sale dates will be posted on the internet.
