By virtue of an Order of Sale issued from the Court of Common Pleas of MAHONING County, Ohio, and to me directed and delivered, I will offer for sale IN THE COMMISSIONERS' HEARING ROOM, Basement of the Courthouse, in YOUNGSTOWN, in said County, on

TUESDAY, MAY 9, A.D. 2017 AND

TUESDAY, MAY 23, A.D. 2017

at 1:30 o'clock P. M. of said day, the following described lands and tenements, to-wit:

Situated in the Township of Boardman, County of Mahoning and State of Ohio and known as being a part of Great Lot No 19 of the Fourth Division of the originial survey of said Township but being more fully described as follows:

Beginning at a point on the centerline of Indianola Road, said point being the southeast corner of lands now or formerly of S. J. & J. L. Popovich as recorded in Deed Volume O.R. 5136, Page 1123 in the Mahoning County Record of Deed, said point being S 86° 11' 16" E a distance of 2404.38 feet from a monument found on the centerline intersection of Indianola Road and the North bound lane of Southern Blvd and the true place of beginning for the parcel herein described. Thence Northerly along the east line of said Popovich lands N 3° 51' 38" E and passing 0.12 feet West of a 1/2" iron pin found at a distance of 25.07 feet, a total distance of 300.00 feet to a point, said point being on the South line of New England Lanes Plat No. 6 as recorded in Plat Volume 33, Page 31, said point also being N 60° 38' 17" W a distance of 0.34 feet from a 1/2" iron pin found. Thence Easterly along the South line of said New England Lanes Plat No. 6 S 86° 02' 00" E a distance of 96.00 feet to a point, said point being Northwest corner of lands now or formerly of J. M. & B. A. Sullivan, said point also being N 24° 59' 27" W a distance of 0.33 feet from a bent 1/2" square iron pin found. Thence Southerly along the west line of said Sullivan lands S 3° 51' 38" W and passing over a 1/2" square iron pin found at a distance of 274.85 feet, a total distance of 300.00 feet to a point on the aforementioned centerline of Indianola Road. Thence Westerly along said centerline of Indianola Road N 86° 02' 00" W a distance of 96.00 feet to the true place of beginning for the parcel herein described. Containing 0.6612 acres of land within the Indianola Road right of way as surveyed by Matthew A. Hart, PS No. 7447 of Advanced Land Measurement, Inc., in Novemebr of 2001 but subject to all legal highways and easements of record.

Basis of bearings for the above described parcel being the centerline of Indianola Road held at 86° 02' 00" as shown on Deed Volume 630, Page 503, and Deed Volume 677, Page 107 of the Mahoning County Records.

AND BEING FURTHER KNOWN FOR STREET NUMBERING PURPOSES AS: 338 Indianola Road, Youngstown, Ohio 44512.

PERMANENT PARCEL NUMBER: 29-009-0-243.00

APPRAISED VALUE: $93,000.00.

Terms of Sale: Deposit in the form of a CERTIFIED CHECK as follows: $2,000.00 if the appraised value is less than or equal to $10,000.00; $5,000.00, if the appraised value is between $10,000.00 and $200,000.00 or $10,000.00 if the appraised value is greater than $200,000.00 (No deposit if Plaintiff is the Purchaser), balance in full within thirty (30) days from THE CONFIRMATION OF SALE.

AND if this sale results in a NO BID/NO SALE and remains unsold after this first sale, then this property shall be offered again at a second sale and shall be sold to the highest bidder without regard to the minimum bid requirement in section 2329.20. (ORC 2329.52(B), ORC 2329.26 (2)(a)(v)).

The purchaser shall be responsible for those costs, allowances and taxes that the proceeds of the sale are insufficient to cover. (ORC 2329.52(B)).

Sheriff's Sales may be canceled due to inclement weather or other county emergency. In such cases, the sale will be held upon the reopening of the Mahoning County Courthouse after the emergency has passed. Republication will not take place. However, notice of the new sale dates will be posted on the internet.
