By virtue of an Order of Sale issued from the Court of Common Pleas of MAHONING County, Ohio, and to me directed and delivered, I will offer for sale IN THE COMMISSIONERS' HEARING ROOM, Basement of the Courthouse, in YOUNGSTOWN, in said County, on

TUESDAY, APRIL 11, A.D. 2017 AND

TUESDAY, APRIL 25, A.D. 2017

at 1:30 o'clock P. M. of said day, the following described lands and tenements, to-wit:

Situated in the Township of Berlin, County of Mahoning and State of Ohio:

And being part of Berlin Township Lot 21, Tract 2 and also known as being all that parcel of land now or formerly owned by Marjorie Carlson as recorded in OR 5427, Page 110 of Mahoning County Records and further bounded and described as follows:

Beginning at a Mahoning County Monument Box at the centerline intersection of Heiser Road 60' and State Route 534, North thence 85 degrees 00 minutes 00 seconds West, a distance of 3323.97 feet to the true place of beginning of the tract of land herein described:

Thence, South 04 degrees 19 minutes 00 seconds West, a distance of 1584.11 feet to a 3/8 inch iron bar found and passing over a 5/8 rebar found at a distance of 30.00 feet;

Thence, North 82 degrees 51 minutes 27 seconds West, a distance of 200.23 feet to a 5/8 inch rebar found;

Thence, North 04 degrees 19 minutes 00 seconds East, a distance of 1576.62 feet to the centerline of said Heiser Road and passing over a capped rebar set at a distance of 1546.62 feet:

Thence, South 85 degrees 00 minutes 00 seconds East, along the centerline of said Heiser Road, a distance of 200.00 feet to the true place of beginning and containing 7.256 acres of land more or less of which 0.138 acres is within the right of way of said Heiser Road as determined by Vaughn R. Kuchenbecker, Professional Surveyor No. 7797 of Campbell and Associates, Inc. in November of 2003.

The bearings used to prepare this description are based on the bearing of Raccoon Road North 85 degrees 00 minutes 00 seconds West, and is found in OR 5247, Page 110. All capped rebar set are 30 inches in length x 5/8 inch, with plastic identification cap "7797".

AND BEING FURTHER KNOWN FOR STREET NUMBERING PURPOSES AS: 16315 Heiser Road, Berlin Center, Ohio 44401.

PERMANENT PARCEL NUMBER: 22-014-0-005.000

APPRAISED VALUE: $148,000.00.

Terms of Sale: Deposit in the form of a CERTIFIED CHECK as follows: $2,000.00 if the appraised value is less than or equal to $10,000.00; $5,000.00, if the appraised value is between $10,000.00 and $200,000.00 or $10,000.00 if the appraised value is greater than $200,000.00 (No deposit if Plaintiff is the Purchaser), balance in full within thirty (30) days from THE CONFIRMATION OF SALE.

AND if this sale results in a NO BID/NO SALE and remains unsold after this first sale, then this property shall be offered again at a second sale and shall be sold to the highest bidder without regard to the minimum bid requirement in section 2329.20. (ORC 2329.52(B), ORC 2329.26 (2)(a)(v)).

The purchaser shall be responsible for those costs, allowances and taxes that the proceeds of the sale are insufficient to cover. (ORC 2329.52(B)).

Sheriff's Sales may be canceled due to inclement weather or other county emergency. In such cases, the sale will be held upon the reopening of the Mahoning County Courthouse after the emergency has passed. Republication will not take place. However, notice of the new sale dates will be posted on the internet.
