By virtue of an Order of Sale issued from the Court of Common Pleas of MAHONING County, Ohio, and to me directed and delivered, I will offer for sale IN THE COMMISSIONERS' HEARING ROOM, Basement of the Courthouse, in YOUNGSTOWN, in said County, on

Situated in the Township of Boardman, County of Mahoning and State of Ohio:

And known as being Part of the Henry A. Withers Farm, situated in Lot 5 of the Third Division of Lots in said Township and more particularly described as follows:

Beginning at a point in the center line of the Youngstown and Boardman Road, 240 feet South from the Northeast corner of said Henry A. Withers Farm, thence West parallel with the North line of the said Henry A. Withers Farm, 250 feet, thence North Parallel with the center line of said Youngstown and Baordman Road, .75 feet; thence East parallel with the North line of said Henry A. Withers Farm, 250 feet to the centerline of Youngstown and Boardman Road, thence South by the centerline of said road .75 feet to the place of beginning and containing within said boundaries, 430/1000 of an acre of land and being the South 75 feet of the premises conveyed to the said Albert A. Withers by deed of Mary E. Withers and others dated March 28, 1914 and recorded in Volume 175 of Deeds at Page 500, Mahoning County Records.

Being the same property conveyed to John J. Ranalli by Deed from Joseph G. Joseph no status, dower release and #40; see affidavit of facts and #41; recorded 06/11/1998 in Deed Volume 3706 Page 238, in the recorder's Office of Mahoning County, Ohio.

AND BEING FURTHER KNOWN FOR STREET NUMBERING PURPOSES AS: 5902 Market Street, Youngstown, Ohio 44512.

PERMANENT PARCEL NUMBER: 29-064-0-096.000

APPRAISED VALUE: $74,000.00.

Terms of Sale: Deposit in the form of a CERTIFIED CHECK as follows: $2,000.00 if the appraised value is less than or equal to $10,000.00; $5,000.00, if the appraised value is between $10,000.00 and $200,000.00 or $10,000.00 if the appraised value is greater than $200,000.00 (No deposit if Plaintiff is the Purchaser), balance in full within thirty (30) days from THE CONFIRMATION OF SALE.

AND if this sale results in a NO BID/NO SALE and remains unsold after this first sale, then this property shall be offered again at a second sale and shall be sold to the highest bidder without regard to the minimum bid requirement in section 2329.20. (ORC 2329.52(B), ORC 2329.26 (2)(a)(v)).

The purchaser shall be responsible for those costs, allowances and taxes that the proceeds of the sale are insufficient to cover. (ORC 2329.52(B)).

Sheriff's Sales may be canceled due to inclement weather or other county emergency. In such cases, the sale will be held upon the reopening of the Mahoning County Courthouse after the emergency has passed. Republication will not take place. However, notice of the new sale dates will be posted on the internet.
