By virtue of an Order of Sale issued from the Court of Common Pleas of MAHONING County, Ohio, and to me directed and delivered, I will offer for sale IN THE COMMISSIONERS' HEARING ROOM, Basement of the Courthouse, in YOUNGSTOWN, in said County, on

 

TUESDAY, SEPTEMBER 3 A.D. 2019 AND

TUESDAY, SEPTEMBER 17 A.D. 2019

at 1:30 o'clock P. M. of said day, the following described lands and tenements, to-wit:

 

Situated in the Township of Beaver, County of Mahoning and State of Ohio:

And known as being all of Sub Lot No. 1 in the Mabel Sarver Plat No. 1, as shown by the recorded plat in Plat Book 42, Page 211 of Mahoning County Record of Plats.

Said Sub Lot No. 1 has a frontage of 180 feet on the Southwesterly line of Woodworth-New Springfield Road and extends back therefrom 261.47 feet on the Northerly line, 396.46 feet on the Southerly line, and has a rear line of 119.05 feet, as appears by said plat, be the same more or less, but subject to all legal highways.

SAVE AND EXCEPT THE FOLLOWING:

Situated in the Beaver Township, County of Mahoning and State of Ohio and known as being a part of Section 2, Township 13, Range 2, in said Township, and is bounded and described as follows:

Being a parcel of land lying on the LEFT side of the centerline of a survey made by the Department of Transportation and recorded in Volume ___, Page ___, of the records of Mahoning County and being located within the following points in the boundary thereof;

Beginning at an angle point in the centerline of Western Reserve Road, distance North 1 degree 54' 06" East, 91.34 feet from a monument box found in the original centerline for State Route 7, as shown in the highway plans for State Route 7, S.H. 82, Section B from 1934, said point being at Station 21+00.00 in the centerline of Western Reserve Road and 20.09' RIGHT of Station 17+86.54 of the centerline of State Route 626;

Thence South 01 degree 48' 46" West, 25.70 feet to a point in the centerline of State Route 626, said point being at State 17+70.52 in the centerline of State Route 626;

Thence South 49 degrees 36' 50" East, along said centerline of State Route 626, 1010.36 feet to a point in the southerly line of land conveyed to H & W Investments Ltd. by instrument recorded in Volume 3708, Page 146 of the Mahoning County Records, said point being 9.24 feet RIGHT of Station 113+10.28 and further being the principal place of beginning;

Thence South 49 degrees 36' 50" East, continuing along said centerline of State Route 626, 184.65 feet to a point at Station 111+26.50;

Thence South 89 degrees 14' 41" West, 38.00 feet to an iron pin set in the existing southwesterly right of way line of State Route 626 (Woodworth Road), said point being 25.00 feet LEFT of Station 111-55.11;

Thence Northwesterly on the arc of a curve deflecting to the left (said curve having a Radius of 912.13 feet, an included angle of 13 degrees 58' 02", and a chord which bears North 57 degrees 45' 32" West and is 221.81 feet in length) a distance of 222.36 feet to an iron pin set in the above said southerly line of land of H & W Investments Ltd., said point being 35.00 feet LEFT of Station 113+83.95;

Thence North 88 degrees 46' 39" East, along said southerly line of land of H & W Investments, Ltd., 84.97 feet to the principal place of beginning and containing 0.149 acres (6503 square feet) of land including the present roadway which occupies 0.106 acres (4,617 square feet) of land as calculated in July, 2009 by Peter J. Knezevic, Ohio Professional Surveyor No. 7249 of CT Consultants, Inc., Registered Engineers and Surveyors.

AND BEING FURTHER KNOWN FOR STREET NUMBERING PURPOSES AS: 9140 Woodworth Road, North Lima, Ohio 44452.

APPRAISED VALUE: $189,000.00.

 

Terms of Sale: Deposit in the form of a CERTIFIED CHECK as follows: $2,000.00 if the appraised value is less than or equal to $10,000.00; $5,000.00, if the appraised value is between $10,000.00 and $200,000.00 or $10,000.00 if the appraised value is greater than $200,000.00 (No deposit if Plaintiff is the Purchaser), balance in full within thirty (30) days from THE CONFIRMATION OF SALE.

AND if this sale results in a NO BID/NO SALE and remains unsold after this first sale, then this property shall be offered again at a second sale and shall be sold to the highest bidder without regard to the minimum bid requirement in section 2329.20. (ORC 2329.52(B), ORC 2329.26 (2)(a)(v)).

The purchaser shall be responsible for those costs, allowances and taxes that the proceeds of the sale are insufficient to cover. (ORC 2329.52(B)).

Sheriff's Sales may be canceled due to inclement weather or other county emergency. In such cases, the sale will be held upon the reopening of the Mahoning County Courthouse after the emergency has passed. Republication will not take place. However, notice of the new sale dates will be posted on the internet.
