By virtue of an Order of Sale issued from the Court of Common Pleas of MAHONING County, Ohio, and to me directed and delivered, I will offer for sale IN THE COMMISSIONERS' HEARING ROOM, Basement of the Courthouse, in YOUNGSTOWN, in said County, on

at 1:30 o'clock P. M. of said day, the following described lands and tenements, to-wit:

 

Situated in the Township of Smith, County of Mahoning and State of Ohio:

And being part of the West half of the Southwest Quarter, Section 28, Township 18, Range 5 and being all of the tract of land transferred to Michael M. and Valerie G. McGrath, as recorded in O.R. 5412, Page 1731, and further described as follows to wit:

Beginning at a monument box found at the centerline intersection of Bandy Road - 50' R/W and Alliance Sebring Road - R/W varies, thence North 88 degrees 57' 46" East, along the centerline of aforesaid Alliance Sebring Road (which is also the quarter section line), a distance of 959.41 feet to a point, which is the true place of beginning for the property herein described;

1. Thence North 88 degrees 57' 46" East, along the centerline of aforesaid Alliance Sebring Road (which is also the quarter section line), a distance of 58.73 feet to a point;

2. Thence South 01 degrees 04' 36" East along the West line of Lot 1 in the H & J Brunie Plat (Vol. 49, Page 146) which is a tract of land now or formerly owned by Robert M. & Karen L. Ackerman (O.R. 1295, Page 363), (and passing over a pinch top pipe found at a distance of 30.68 feet), a total distance of 742.54 feet to A 3/4" iron pipe found;

3. Thence South 89 degrees 18' 03" West, along the North line of a tract of land now or formerly owned by Arthur E. and Edna F. Teeters (TR) (O.R. 6122, Page 2426 - Tract 1), a distance of 58.66 feet to a 3/4" iron pipe found;

4. Thence North 01 degrees 04' 56" West, along the East line of a tract of land or formerly owned by Arthur E. and Edna F. Teethers (TR) (O.R. 6122, Page 2426 - Tract 2), (and passing over a 3/4" iron bar found at a distance of 711.56 feet), a total distance of 742.20 feet to a point in the centerline of the aforesaid Alliance Sebring Road and the true place of beginning of the herein described parcel.

Containing 1.0003 of land, based on a field survey by Beth A. Pearson, P.S. #8430 in June 2015.

APPRAISED VALUE: $53,000.00.

 

Terms of Sale: Deposit in the form of a CERTIFIED CHECK as follows: $2,000.00 if the appraised value is less than or equal to $10,000.00; $5,000.00, if the appraised value is between $10,000.00 and $200,000.00 or $10,000.00 if the appraised value is greater than $200,000.00 (No deposit if Plaintiff is the Purchaser), balance in full within thirty (30) days from THE CONFIRMATION OF SALE.

AND if this sale results in a NO BID/NO SALE and remains unsold after this first sale, then this property shall be offered again at a second sale and shall be sold to the highest bidder without regard to the minimum bid requirement in section 2329.20. (ORC 2329.52(B), ORC 2329.26 (2)(a)(v)).

The purchaser shall be responsible for those costs, allowances and taxes that the proceeds of the sale are insufficient to cover. (ORC 2329.52(B)).

Sheriff's Sales may be canceled due to inclement weather or other county emergency. In such cases, the sale will be held upon the reopening of the Mahoning County Courthouse after the emergency has passed. Republication will not take place. However, notice of the new sale dates will be posted on the internet.
