By virtue of an Order of Sale issued from the Court of Common Pleas of MAHONING County, Ohio, and to me directed and delivered, I will offer for sale IN THE COMMISSIONERS' HEARING ROOM, Basement of the Courthouse, in YOUNGSTOWN, in said County, on

at 1:30 o'clock P. M. of said day, the following described lands and tenements, to-wit:

 

The following described real estate situated in the Township of Beaver, County of Mahoning and State of Ohio:

in the Northeast Quarter of Section 2 and being all that is conveyed to Scott R. Coler in Official Records Volume 3114, Page 339, all records being of the Recorders Office, Mahoning County, Ohio unless otherwise noted and being more particularly described as follows:

Beginning at a monument found at the intersection of Calla Road and Woodworth Road;

Thence along the center of said Woodworth Road, North 21 degrees 52 minutes 25 seconds West, 3332.59 feet to a point at the Southeasterly corner of subject tract, in the center of said Woodworth Road, at the Northeasterly corner of a 0.33 acre tract conveyed to Mary M. Coler in Official Records Volume 1885, Page 343 and being the principal place of beginning of the herein described parcel;

Thence, along the Southerly line of subject tract and the Northerly line of said 0.33 acre tract, South 72 degrees 42 minutes 17 seconds West, passing a 5/8 inch rebar found at 30.22 feet, 268.79 feet to a 5/8 inch rebar found at the Southwesterly corner of subject tract, at the Northwesterly corner of said 0.33 acre tract, in the Easterly line of a 3.227 acre tract conveyed to Armstrong Utilities Inc. in Official Records Volume 927, Page 81;

Thence, along the Westerly line of subject tract and the Easterly line of said 3.227 acre tract, North 03 degrees 23 minutes 00 seconds East, 352.63 feet to a 1 inch iron pipe found at the Northwesterly corner of subject tract, in the Easterly line of said 3.227 acre tract and the Southerly line of a 18.373 acre tract conveyed to Armstrong Utilities Inc in Official Records Volume 1886, Page 229:

Thence, along the Northerly line of subject tract and the Southerly line of said 18.373 acre tract, North 86 degrees 30 minutes 00 seconds East, passing a 5/8 inch rebar found 92.84 feet, 124.56 feet to a point in the center of Woodworth Road, at the Northeasterly corner of subject tract and the Southeasterly corner of said 18.373 acre tract;

Thence, along the Easterly line of subject tract and the center of said Woodworth Road, South 21 degrees 43 minutes 59 seconds East, 301.11 feet to the place of beginning, containing 1.427 acres more of less, subject however to all legal easements, restrictions and rights of way of record and records in their respective utility offices.

This description is based on an actual field survey completed on September 10, 2002 and is in accordance of administrative code 4733-37, iron pins set are 30 inch x 1 inch O.D. with orange plastic caps inscribed Ginnetti P.S. 8104. Basis of bearings is the Easterly line of a 3.227 acre tract conveyed to Armstrong Utilities Inc as North 03 degrees 23 minutes 00 seconds East per Official Records Volume 927T Page 81, and is for angular purposes only.

AND BEING FURTHER KNOWN FOR STREET NUMBERING PURPOSES AS: 9424 Woodworth Road, North Lima, Ohio 44452.

APPRAISED VALUE: $38,000.00.

 

Terms of Sale: Deposit in the form of a CERTIFIED CHECK as follows: $2,000.00 if the appraised value is less than or equal to $10,000.00; $5,000.00, if the appraised value is between $10,000.00 and $200,000.00 or $10,000.00 if the appraised value is greater than $200,000.00 (No deposit if Plaintiff is the Purchaser), balance in full within thirty (30) days from THE CONFIRMATION OF SALE.

AND if this sale results in a NO BID/NO SALE and remains unsold after this first sale, then this property shall be offered again at a second sale and shall be sold to the highest bidder without regard to the minimum bid requirement in section 2329.20. (ORC 2329.52(B), ORC 2329.26 (2)(a)(v)).

The purchaser shall be responsible for those costs, allowances and taxes that the proceeds of the sale are insufficient to cover. (ORC 2329.52(B)).

Sheriff's Sales may be canceled due to inclement weather or other county emergency. In such cases, the sale will be held upon the reopening of the Mahoning County Courthouse after the emergency has passed. Republication will not take place. However, notice of the new sale dates will be posted on the internet.
